This is the last
Will
and Testament of me
William
Leppard
of Bolney in the
county
of
Sussex
Yeoman. I give and devise
unto my wife Frances Leppard all the freehold messuage consisting of two
tenements or dwellings with the gardens orchard hereditaments and
premises thereto belonging situate lying and being in the parish of
Bolney aforesaid and now in the xxxx
tenancy or occupations of Richard King and my son James Leppard to hold
the said unto my said wife Frances Leppard and her assigns for and
during the term of her natural life.
And from and immediately after her decease I give and devise the
said messuage gardens orchard hereditaments and premises unto and to the
use of my said son James Leppard his heirs and assigns for ever.
Also I give and bequeath unto my said wife Frances Leppard all my
household furniture brewing and Dairy Utensils beds bedding place linen
china and Glass and also my stock of liquors which I may have in my
gurebing house at the time of my decease to and for her own use and
benefit absolutely and forever. Also
I give and bequeath unto my said son James Leppard my lease of Bolney
Place farm and lands or such of the lands thereof as I may be in
possession of at the time of my decease to hold the same unto my said
son James Leppard his Exors admons and assigns for all the residue of
such term and terms of years which shall be unexpired at the time of my
decease. Also I give and
bequeath to my respected friend Richard Baker of Cowfold in the said
county of Sussex gentleman and my son-in-law John Barber of Bolney
aforesaid Miller the sum of five hundred pounds sterling to be paid them
by my executor hereinafter named within six calendar months next after
my decease upon trust nevertheless that they the said Richard Baker and
John Barber and the survivor of them and the Exors or admons of such
survivor do and shall as soon as conveniently may be after the receipt
thereof place the said sum of five hundred pounds out at interest upon
government or other good real security or securities in the name of them
the said Richard Baker and John Barber or in the name of the survivor of
these or the Executors or admons of such survivor and pay the interest
dividends and proceeds thereof from time to time as the said shall be
received by them or him unto my said wife Frances Leppard for and during
the term of her natural life. And
from and immediately after the decease of my said wife then I trust to
pay and equally divide the said principal sum of five hundred pounds and
all interest which may then be due and owing thereon unto and amongst my
five children namely Philip Leppard William Leppard Philadelphia the
wife of William Charman Henry Leppard and Kitty the wife of John Barber
share and share alike and which I so hereby give and bequeath to therein
respectively accordingly also I give and bequeath unto the said Richard
Baker and John Barber the sum of one hundred pounds sterling to be paid
them by my said Executors hereinafter named within six calendar months
next after my decease upon trust nevertheless that they the said Richard
Baker and John Barber and the survivor of them and the Exors or admons
of the survivor so and shall as soon as conveniently may be after the
receipt. I hereof place the
said sum of one hundred pounds out at interest upon government or other
good real security or securities in the names of them the said Richard
Baker and John Barber or in the name of the survivor of them or the
Exors or admons of the survivor and pay the interest dividends and
proceeds thereof from time to time as the same shall be received by them
or him unto my daughter Elizabeth the wife of Cornelius Muzzell for and
during the term of her natural life to and for her own sole and separate
use and benefit whose sole and separate receipt and receipts for the
same shall notwithstanding constitute a sufficient and effectual
discharge and discharges to my said trustees or other of their Executors
or admons. And from and
after her decease then In trust to pay and equally divide the said sum
of one hundred pounds and all interest which may there be due and owing
thereon unto and amongst all and every child or children of my said
daughter Elizabeth Muzzell lawfully to be begotten if more than one
share and share alike. And
if but one then the whole to xxx
and to be paid to him her or them respectively as and when they
severally attain their age or respective ages of twenty one years.
And in case any or other of the said children shall happen to
depart this life under the said age of twenty one years without leaving
issue of his her or their body or bodies lawfully begotten then the part
or share parts or shares of him her or them so dying shall fall to and
be equally divided amongst the survivors or survivor of them share and
share alike but in case it shall happen that all and every such child
and children shall depart this life under this age of twenty one years
and without leaving issue of his her or their body or bodies lawfully
begotten then the trust to pay or equally divide the said sum of one
hundred pounds and the interest paid out and owing thereon unto and
amongst all my children viz the said James Leppard Philip Leppard
William Leppard Philadelphia Charman Henry Leppard John Leppard and
Kitty Barber share and share alike and which I do hereby give and
bequeath to them respectively accordingly. Also I give and bequeath unto
the said Richard Baker and John Barber the sum of one hundred pounds
sterling to be paid them by my said Executor hereinafter named within
six calendar months after my decease upon trust nevertheless that they
the said Richard Baker and John Barber and the survivor of them and the
Executors or admons of such survivor do and shall as soon as
conveniently may be after the receipt thereof place the said sum of one
hundred pounds out at interest upon government or other good real
security or securities in the names of them the said Richard Baker and
John Barber or in the name of the survivor of them or the Exors or
admons of the survivor and pay the interest dividends and proceeds
thereof from time to time as the same shall be received by them or him
unto my said son John Leppard for and during the term of his natural
life and I do hereby declare that all and every receipt and receipts for
the same signed by himself in his own proper handwriting shall only be
sufficient and effectual discharge and discharges to my said trustees or
such of them their or either of their Exors or admons and from and after
the decease of my said son John Leppard then In trust to pay and equally
divide the said sum of one hundred pounds and all interest which may be
then due out and owing thereon unto and amongst all and every the child
and children of my said son John Leppard lawfully to be begotten if more
than one share and share alike and if but one then the whole to such one
and to be paid to him her or them respectively as and when they
severally attain their age or respective ages of twenty one years.
And in case any or other of the said children shall happen to
depart this life under the said age of twenty one years without leaving
issue of his her or their body or bodies lawfully begotten then the part
or share parts or shares of him her or them so dying shall fall to and
be equally divided amongst the survivors or survivor of them share and
share alike and it is my will that the share or several shares of the
respective child or children of my said daughter Elizabeth Muzzell and
my said son John Leppard shall become a vested interest in such child or
children at his her or their age or respective ages of twenty one years
or dying before that age leaving lawful issue notwithstanding his her or
their respective parent may be then living.
And after and subject to the payment of my just debts funereal
and testamentary expenses and the several sums of five hundred pounds
one hundred pounds and one hundred pounds hereinbefore by me given to
the said Richard baker and John Barber in trust as aforesaid all which
debts expenses and sums of money I direct my Executors hereinafter named
to pay and discharge. I give
and bequeath all the rest and residue of my personal estate and effects
not hereinbefore disposed of whatsoever and wheresoever and of what
nature definedsoever the same may be which I may die possessed of
interested in or entitled unto or xx which I have a disposing power in
manner following that is to say one month or half part thereof I give
and bequeath unto my said son James Leppard his Exors admons and assigns
absolutely and forever. And
as to the remaining moiety or half part thereof I give and bequest the
same unto eth said Richard baker and John Barber their Exors and admons
upon trust that they do said Richard baker and John Barber so and shall
as soon as conveniently may be after my decease sell dispose of and
convert into money all such part and parts thereof as shall not consist
of money first offering the said to my said son James Leppard at a fair
valuation to be made by two impartial persons one to be chosen by my
said son and the other by the said trustees and in case he shall refuse
to take and pay for the same according to such valuation then to sell
and dispose of the same either by public sale or private contract as to
them or the survivor of them or the Exors or admons of such survivor
shall think best and as to the monies arising by such sale and
disposition together with such part or parts of such remaining moiety of
my said personal estate as shall consist of money I do hereby declare
and direct that the said Richard Baker and John Barber and the survivor
of them and the Exors and Admons of such survivor shall xxx and be
possessed of the same. In
trust to place the same out at interest upon government or other good
real security or securities in the names of them the said Richard Baker
and John Barber or in the name of the survivor of them or the Exors or
admons of the survivor and pay the interest dividends and proceeds
thereof from time to time as the same shall be received by them or him
unto my said wife Frances Leppard for and during the term of her natural
life. And from and
immediately after the decease of my said wife then in trust to pay and
equally divide the said principal monies and all interest which may be
then out and owing thereon unto and amongst all and every my said
children (except of my said son James ) namely the said Philip Leppard
William Leppard Philadelphia Charman Henry Leppard John Leppard and
Kitty Barber share and share alike and which I do hereby give and
bequeath to them respectively accordingly.
And I do declare that they the said Richard Baker and John Barber
or either of them their or either of their Executors or admons shall not
be charged with or answerable or accountable for more of the aforesaid
trust monies and provided that they shall respectively actually receive xxx with or for the loss of any monies that shall
happen by any ways occurable whatsoever without his or their wilful
neglect of default and also that it shall be lawful for the said Richard
Baker and John Barber or either of them their or either of their
Executors or admons of such survivor in eth first place by and out of
the said trust monies to deduct and reimburse himself and themselves all
such rates charges damages and expenses which they shall sustain expend
or be put unto for or by reason or on account of the performance
management and execution of the trusts hereby imposed on them.
And I constitute and appoint my said son
James
Leppard
sole executor of this will.
And lastly I revoke all former wills by me made in witness
whereof I the said William Leppard the testator have to this my last
will and testament contained in four sheets of paper set my hand and
seal at the top of the first sheet where the same art affixed together
my hand at the bottom thereof and at the bottom of the second and third
sheets and my hand and seal to this fourth and last sheet thereof the
sixth day of November in the year of our Lord one thousand eight hundred
and nine William Leppard signed sealed published and declared by the
said William Leppard the testator as and for his last will and testament
in the presence of us who in his presence at his request and in the
presence of each other have subscribed our names as witnesses.
