Will of Sarah Cogger
of Brixton 1831/4
This is the last will and testament of me Sarah Cogger of Brixton in
the county of Surrey Spinster as follows whereas my late brother John
Cogger by his Will bearing date the twenty sixth day of August one
thousand seven hundred and ninety eight after directing the payment of his
debts and funeral expenses gave devised and bequeathed all the rest
residue and remainder of his estate and effects of what nature or kind
over unto me his sister then living with him and to John Porter and James
Byers therein named in Trust that
they should xx the estate for the purpose of that his will viz that I his
said sister and his two daughters should have all the benefit arising from
that he was possessed of share and share alike to be equally divided and
in case his said daughters Elizabeth and Mary Ann should die before the
decease of me his said sister so gave devised and bequeathed the same unto
me his said sister by virtue of which bequests in his said will I am
entitled to one undivided third part or share (the whole into three equal
parts or shares to be divided) of and in certain the Leasehold Premises
situate and being at Brixton aforesaid in the said County of Surrey and
also to a contingent interest in the whole of the said leasehold premises
in case I should happen to survive my two nieces Elizabeth Cogger the wife
of John Grimshaw Cogger and Mary Ann Cogger late the wife of Roger Wall
but since deceased and whereas I am by virtue of divers
xx ajoinment and other asx in the xx xx entitled to all that the
undivided third part or share and interest of the said John Grimshaw
Cogger and Elizabeth his wife (the whole into three parts or shares to be
divided) of and in the said Leasehold Premises or to such part share or
interest as the said John Grimshaw Cogger and Elizabeth his wife or the
said John Grimshaw Cogger in her right were or was entitled at the time of
making such assignments and xx and xx xx respectively now I the said Sarah
Cogger do hereby give and bequeath all that my said undivided third part
or share of and in the said Leasehold Estate and Premises at Brixton
aforesaid and also all/such contingent Estate or interest as I may be
entitled unto in the same Premises in the event before mentioned and also
all such other parts shares or interests part share or interest of and in
the said undivided third part or share of the said John Grimshaw Cogger
and Elizabeth his wife or of the said John Grimshaw Cogger in her right in
and to the said leasehold premises to which I am now or may hereafter be
entitled and also all my money in the three and a half per centum bank
annuities or in any other stocks or funds and all other my goods chattels
and Personal estate and effects of what nature or kindsoever or whatsoever
unto John Plummer of Brixton aforesaid Carpenter and Thomas Cogger of
Merton in the said county of Surrey Tailor
their executors admons upon trust thereout in the first place to
pay all my debts and funeral and testamentary expenses and after payment
thereof then that they the said John Plummer and Thomas Cogger or the
survivor of them his Executors or Admons do and xx xx and be seized and
possessed thereof upon the several trusts and to and for the several xx
intents and purposes hereinafter mentioned that is to say Upon Trust as
soon as can be after my decease to pay assign or transfer the sum of fifty
pounds part of the said three and a half per centum bank annuities
together with all dividends and interest which may be then due thereon
unto my dear sister Betty Wilson the wife of Humphrey Wilson both now
residing with me to and for her own sole and separate use and benefit free
from the debts control or engagements of her present husband or any future
husband and I direct that the receipt or receipts about of my said sister
notwithstanding her cxx shall be a good and sufficient discharge or good
and sufficient discharges to my said trustees for such money as in such
receipt or receipts shall be expressed to be received respectively and I
hereby direct that my trustees or
the survivor of them or the Exors or Admons of such a survivor do and
shall permit and suffer my said sister Betty Wilson and her said husband
Humphrey Wilson to live and reside in the house and Premises which I now
dwell in and occupy and to have and enjoy the furniture fixtures utensils
linen and other things therein and thereout for and during the time of
their respective natural lives and the life of the survivor of them
without owing any rent whatsoever for the same save only the proportion of
the Ground rent to the amount due for the same premises and keeping the
same premises in good and tenantable aspect and condition and also as soon
as can be after my decease in like manner to pay assign or transfer a like
sum of fifty pounds further part of my said three and a half per centum
bank annuities and all dividends and interest which may be then due
thereon into the proper hands of my niece the said Elizabeth Cogger the
wife of the said John Grimshaw Cogger of Brixton aforesaid to and for her
own sole and separate use and benefit free from the debts control or
engagements of her present husband or any future husband and I direct that
her receipt or receipts above notwithstanding her coverture shall be a
good and sufficient discharge or good and sufficient discharges to my said
Trustees and the survivor of them his Executors or Admons for so such
money as in such receipt or receipts respectively shall be xx
to be received and upon further trust as soon as can be after my
decease to pay assign or transfer a
like sum of fifty pounds each further part of my said three and a half per
centum bank annuities and all dividends and interest which may be then due
thereon unto Elizabeth Cogger my great niece and John Cogger my great
nephew daughter and son of my said niece Elizabeth Cogger to and for her
and his own use and benefit respectively
and upon further trust to pay and apply the dividends interest and
product of two other sums of fifty pounds further part of my said three
and a half per centum bank annuities for and towards the support,
maintenance and education of my Great Nephews William Cogger and Thomas
Cogger two other sons of my said niece Elizabeth Cogger during their
respective minorities and when and so soon as they shall respectively
attain their ages of twenty one years then upon a trust to pay assign or
transfer the share of such Child so attaining that age of and in the said
two sums of fifty pounds three and a half per centum bank annuities and
all dividends and interest which may be then due thereon unto such child
to and for his own use and benefit and upon trust to receive the xx issues
and xx of such other part of my said Leasehold Estate and parts or shares
thereof the use and enjoyment of which is not given to my sister Betty
Wilson and her husband as aforesaid and also the dividends and interest of
my said stocks funds if any
shall remain after the appropriations hereinbefore directed and other my
personal estate and effects as and when the same shall respectively become
due and payable and shall and to pay the same into the proper hands of my
niece Elizabeth Cogger the wife of John Grimshaw Cogger to and for her own
sole and separate use and benefit for and during the term of her natural
life and I direct that the same shall not be subject or liable to the
debts control or engagements of the said husband John Grimshaw Cogger or
of any other husband withsoever she may she may hereafter happen to marry
and I also direct that the receipt or receipts of my said niece
notwithstanding her coverture shall be a good and sufficient discharge or
good and sufficient discharges to my said Trustees or the survivor of them
or to the Exors or Admons of such survivor for such sum or sums of money
as in such receipt or receipts shall be expressed to be received
respectively and from and immediately after the decease of my said niece
Elizabeth Cogger then upon trust that my said Trustees or their survivor
his Exors or Admons shall and do subject nevertheless to the life estate
and interest of my said sister and her said husband as here insofar
mentioned pay such rents and profits stocks and funds and dividends and
interest thereof if any shall remain unappropriated unto and between or
amongst the said John Grimshaw Cogger the said Elizabeth Cogger his
daughter and John Cogger William Cogger and Thomas Cogger his sons by my
niece Elizabeth Cogger for and during the natural life of the said John
Grimshaw Cogger with a benefit of survivorship to the others of such
children in case any of them shall die under the age of twenty one years
unmarried and without leaving lawful issue and from and immediately after
the decease of the said John Grimshaw Cogger then I direct subject as
aforesaid that the share of the said John Grimshaw Cogger of and in the
said rents and profits stocks and funds and dividends and interest thereof
if any shall go to and be equally divided between or amongst his said four
children or such of them as shall be living at the time of his decease
until they shall severally attain their respective ages of twenty one
years for and towards their maintenance and education respectively and
when and as soon as any of the said children shall attain her his or their
age or respective ages of twenty one years then upon trust as aforesaid to
pay the share or shares of any such child or children so attaining their
age or respective ages of twenty one years as aforesaid together with all
rents and profits dividends and interest which may be then due thereon
unto such child or children respectively to and for his or their own
respective use and benefit and I also direct that it shall be lawful for
my trustees or the survivor of them or his Exors or Admons to advance all
or any part of the share or shares of the said William Cogger and Thomas
Cogger of and in the said two sums of fifty pounds of the said three and a
half per centum bank annuities as they or he shall or may in their or his
direction think fit for putting him or them out apprentice or for the
purpose of his or their advancement in life and from and after the decease
of my said sister Betty Wilson and her said husband respectively and when
and as soon as all the said children shall have attained their respective
ages of twenty one years then
upon trust that they my said trustees do and shall if they shall think it
fit and advisable make sale and dispose of all my said Leasehold estate
and Interest in the said premises and all other my goods and chattels
Personal estate and effects whatsoever by public auction for the best
price and most money that can be had or gotten for the same and after
payment of all cash charges and expenses which they my said trustees may
sustain expend or be put unto in and about such sale or otherwise in
the direction of the trust of this my will then to pay and divide
the net product thereof and also the said funds dividends and interest if
any shall remain after the appropriations aforesaid unto and equally
between or amongst the said four children Elizabeth Cogger
John Cogger William Cogger and Thomas Cogger share and share alike
and case any of such children shall die under twenty one years
having left lawful issue I direct that the share or shares of the child or
children so dying shall go to and be equally divided between or amongst
such issue and I direct that the receipt or receipts of my said trustees
or the survivor or his Exors or Admons shall be a good and sufficient
discharge or good and
sufficient discharges to the purchaser or purchasers of the said Leasehold
Premises for the purchase money for the same and that such purchaser or
purchasers shall not be bound to set to the application of such purchase
money and also that my said Trustees or either of them shall not be
accountable for the acts deeds xx or defaults of the other of them but
each of them for his own acts deeds xx or defaults only nor for any loss
which may be sustained by any banker in whose hands such monies may happen
to be placed for safe custody and whereas some difficulties may arise in
the making sale of my said part shares and interests in the said Leasehold
Premises on account of such estate not having been severed and partitioned
I therefore direct my trustees or the survivor of them his Exors or Admons
as soon as may be after my decease in case the same shall not be sooner
effected to endeavour to effect such severance and partition of my said
leasehold property for the more effectually facilitating such sale and
converting the same into money but in the meantime and until such
severance and partition can be effected
to pay the rent and profits thereof and of my other Personal estate
in such manner as I have hereinbefore directed concerning the same and I
nominate and appoint my friends the said John Plummer and Thomas Cogger
joint Executors of this my last will and testament and Guardians of such
of the said children after the decease of their said father as may be
under the age of twenty one years during their respective minorities and I
give to each of them my said Trustees and Executors the sum of five pounds
as a small remuneration for the trouble they may have in and about the
execution of the trusts of this my Will and Testament
